Withdrawal from the contract or return of goods is therefore fundamentally excluded, unless otherwise explicitly agreed in writing.

Returns

• Returns are accepted only with the prior written consent of Black Hammer GmbH.

• Goods sent without prior authorization may be rejected or returned at the buyer's expense.

• The return of goods does not automatically imply the recognition of a claim.

Opened Products

For reasons of health protection and product safety, opened, unsealed, or already used dietary supplements, sports nutrition, or food products are fundamentally excluded from return.

Claims and Transport Damage

• The goods must be inspected immediately upon receipt.

• Obvious transport damage, shortages, or incorrect deliveries must be reported in writing within 5 working days of receipt.

• Claims must be documented with meaningful photographs.

• After this period has elapsed, the goods are deemed to have been delivered and accepted in proper condition.

Liability for Defects

In the case of proven defective goods, Black Hammer GmbH reserves the right, at its own discretion, to provide replacement goods, issue a credit note, or otherwise remedy the defect.

Limitation of Liability

The liability of Black Hammer GmbH is limited to the value of the delivered goods.

Liability for lost profit, loss of sales, consequential damages, or other indirect damages is excluded to the extent permitted by law.

Retention of Title

The delivered goods remain the property of Black Hammer GmbH until full payment of all claims arising from the business relationship has been made.

Place of Jurisdiction and Applicable Law

The law of the Federal Republic of Germany applies exclusively.

The place of jurisdiction for all disputes arising from or in connection with the business relationship is Münster, Germany, to the extent permitted by law.
